Terms of Service

1. Acceptance of terms

By using the resident portal for The Bower ("the Service"), you agree to these Terms. If you do not agree, do not use the Service.

2. Account eligibility

You must be at least 18 years old and a current resident, staff member, or authorized contact of The Bower to use the Service. Your account is for your personal use and may not be shared.

3. Your responsibilities

• Keep your password confidential and notify us immediately of any unauthorized use.
• Provide accurate information when submitting maintenance requests, rent payments, or guest passes.
• Do not use the Service to harass other residents, staff, or third parties.
• Do not attempt to access areas of the Service you are not authorized to use.

4. Rent payments

Rent payments are processed by Stripe, Inc. You authorize us to charge the payment method you provide for amounts owed under your lease. You remain responsible for rent owed regardless of any processing error. Refunds are governed by your lease agreement, not by these Terms.

5. Maintenance requests

The Service lets you request maintenance for your unit. It is not a substitute for emergency services — for a life-safety emergency, call 911. For after-hours emergencies at the property, call the number posted on the Emergency line.

6. Availability

The Service is provided "as is." We aim for high availability but do not guarantee uninterrupted access. Scheduled maintenance, third-party outages, and events beyond our control may cause temporary disruptions.

7. Limitation of liability

To the fullest extent permitted by law, our liability for any claim arising from the Service is limited to the fees you paid us (if any) in the three months before the claim arose. We are not liable for indirect, consequential, or punitive damages.

8. Termination

We may suspend or terminate access for violation of these Terms or when your lease ends. You may delete your account at any time by contacting us.

9. Governing law

These Terms are governed by the laws of the State of Florida without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Florida.

10. Changes

We may update these Terms from time to time. Material changes will be announced via email or an in-app notice at least 14 days before they take effect.
